This article documents an important procedural development in the 1996 Warnervale Airport controversy. Although the Warnervale Airport (Restrictions) Bill had passed both houses of NSW Parliament, the newspaper reported in December that it had not yet been formally proclaimed and therefore had not taken legal effect.
The report raised the possibility that Traders Finance and Wyong Council could continue with the airport redevelopment under existing approvals while the legislation remained unproclaimed. Central Coast MLC Mike Gallacher used the situation to criticise the Carr Government and question its commitment to restricting the development.
The article is particularly valuable because it demonstrates that passage of the legislation did not immediately settle the airport’s future. Questions surrounding commencement of the Act, existing development approvals and State Government intentions continued months after Parliament had approved the restrictions.
